Authorisation to use feed additives not authorised in the EU, for research purposes
Two recent French laws, Act No. 2020-1525 of 7 December 2020 on accelerating and simplifying public action and Decree No. 2022-1599 of 20 December 2022, transferred to ANSES responsibility for authorising the use as feed additives of substances which are not authorised at EU level, with the exception of antibiotics, for experiments for scientific purposes, when the experiments are carried out under livestock farming conditions or when the animals on which the experiments are conducted are intended for the food chain.
This task is carried out pursuant to Article 3(2) of Regulation (EC) No 1831/2003 of the European Parliament and of the Council of 22 September 2003 on additives for use in animal nutrition, and is intended to ensure safety for the animals, the user of the additives, consumers and the environment.
ANSES issues its authorisation decision based on an opinion following a collective expert appraisal to assess the risks, carried out by its Expert Committee on "Animal Feed".
Procedure to be followed by applicants for submitting authorisation applications
A substance is considered to be unauthorised if it has not been authorised as a feed additive in accordance with the aforementioned Regulation of 22 September 2003, or if it is used without complying with the conditions of use laid down in this Regulation and in the authorisation granted to the substance, in particular with regard to composition, target species or animal categories, administration methods or function.
Authorisation applications must be presented according to the following procedure:
